Liaison with Council enforcement teams

Planning permission is often complex and changes to the design can often have knock on consequences. Talking with enforcement teams early on, can often prevent formal enforcement being undertaken. Brighton Planning will have the necessary conversations with the local authority on your behalf to establish to negotiate the best solutions to the problems.

Enforcement appeals

Enforcement appeals are based on seven grounds and can be undertaken in different ways from written statements to public inquiries. Appeals set out both the planning case and any legal precedents. Brighton Planning have substantial experience in providing all the necessary evidence required to make the best possible enforcement appeal case.

Expert witness and statements

Sometimes more complex appeals require expert witnesses to take an independent look at the case and provide evidence as to their findings. Brighton Planning have experience of providing such evidence both at appeals and at court.

Certificate of lawfulness applications

Buildings can be immune from enforcement action if the unauthorised works have been undertaken for several years and not acted on by the Council. If this is the case, then evidence to that fact can be supplied to the Council via a Certificate of Lawfulness application which will provide the client with documentation that immunity has been gained and no further enforcement action can be undertaken.
